Minnesota Title Evidence of Ownership

All Minnesota real property offers one of two general types of Minnesota Title Evidence of Ownership:

  1. The Abstract Property form of title evidence;

or

  1. The Registered Property form of title evidence – the Torrens Property Certificate of Title.

Minnesota Abstract Property

Real property that offers the Abstract Property form of Minnesota Title Evidence of Ownership has not been registered pursuant to the Torrens real property registration system, but is based upon an abstract of title – a complete compilation of all title documents which have been recorded at the County Recorder’s office – beginning with the original Congressional grant or patent from the U.S. Government.

Minnesota Registered Property

There are two types of title evidence offered by the Registered Property system:

  1. a complete registration of title resulting from a judicial process identified in Minnesota Statutes, Chapter 508;

and

  1. a provisional registration of title resulting from an administrative process identified in Minnesota Statutes, Chapter 508A – which is less expensive, and quicker – than the judicial process identified in Minnesota Statutes, Chapter 508.

Minnesota Abstract Property and Registered Property

Some owners of Minnesota real property have titles which offer both forms of Minnesota Title Evidence of Ownership:

  1. one or more adjacent parcels offering the Abstract Property form of title evidence;

            and

  1. one or more adjacent parcels offering the Registered Property form of title evidence.

Minnesota real property owners in such a situation would be well advised to consider registering their Abstract Property pursuant to the administrative process identified in Minnesota Statutes, Chapter 508A.
